1. Introduction

1.1. These Terms and Conditions ("Terms") govern your use of the website www.pathavifarms.com ("Website") and any purchase of products from Pathavi Farms, having its registered office at Floor No.: 2ND, Building No./Flat No.: 29 C11, Shiv Shakti Apartments, Pocket 2, Rohini Sector — North West Delhi, New Delhi - 110085 (hereinafter referred to as "Pathavi Farms", "we", "us" or "our").

1.2. By registering, accessing, browsing, or using this Website, or by placing an order through it, you ("you" or "Customer") agree to be bound by these Terms, our Privacy Policy, our Cancellation & Refund Policy, and our Shipping & Exchange Policy (collectively, "Policies"). If you do not agree to any of these Terms or Policies, you must not access or use the Website or purchase any products.

1.3. Throughout these Terms, words in singular include the plural and vice versa, and "including" means "including without limitation."

2. Eligibility & Registration

2.1. You must be at least 18 years old to place an order on this Website. By placing an order, you represent and warrant that you are at least 18 years of age and possess the legal right and capacity to enter into these Terms.

2.2. To make a purchase, you may be required to create an account by providing a valid email address, name, shipping address, phone number, and a secure password. You agree to (a) provide accurate, current, and complete information during registration and (b) maintain and promptly update your account information to keep it accurate and complete.

2.3. You are responsible for safeguarding your password and other login credentials. You agree to notify us immediately at help@pathavifarms.com of any unauthorized use of your account.

3. Products, Pricing & Payment

3.1. Products

Pathavi Farms sells the following products:

  • Mustard Oil
  • Ghee
  • Honey

3.2. Pricing

All prices displayed on the Website are in Indian Rupees (₹) and are inclusive of applicable taxes (GST). Pathavi Farms reserves the right to modify prices at any time, without prior notice. Pricing changes will not affect orders already confirmed by us.

3.3. Payment Methods

We accept online payments only (no Cash on Delivery). Available methods include:

  • Credit/Debit Cards (Visa, MasterCard, RuPay, etc.)
  • UPI (e.g., GPay, PhonePe, Paytm)
  • Net Banking
  • Payment Gateway: Razorpay (acting as our authorized payment processor)

3.4. Payment Authorization

By placing an order, you represent and warrant that the payment information you provide is valid and that you are authorized to use it. We are not responsible for any loss or damage arising from your unauthorized use of any payment method.

3.5. Order Acceptance

All orders placed through the Website are subject to our acceptance. We reserve the right to refuse or cancel any order for any reason, including but not limited to:

  • Product availability issues;
  • Errors in product descriptions, pricing, or other fee information;
  • Suspected fraudulent or unauthorized transactions;
  • Other legitimate business reasons.

4. Order Fulfillment & Shipping

4.1. Delivery Areas. We ship pan-India and to select international destinations. All deliveries are subject to customs clearance (for international orders) and applicable laws in the destination country.

4.2. Shipping Methods & Carriers. We use the following carriers: Delhivery and DTDC.

  • Normal Shipping (free of charge): Estimated delivery within 4–6 working days from date of dispatch (subject to destination PIN code).
  • Express Shipping (additional ₹40 per order): Estimated delivery within 2–4 working days from date of dispatch (subject to destination PIN code).

4.3. Shipping Schedule & Sundays. We do not deliver on Sundays. Orders received on Fridays or Saturdays will be dispatched on the next working day.

4.4. Dispatch & Tracking. Once your order is accepted and dispatched, we will send you a confirmation email or SMS with a tracking number. Delivery times are estimates only; we do not guarantee delivery by a specified date.

4.5. Shipping Restrictions.

  • We comply with all governmental regulations governing the shipment of edible oils, ghee, and honey.
  • If a shipment is returned to us due to an incorrect address or if the Customer repeatedly refuses delivery, we reserve the right to treat the order as canceled and refund any amounts paid, less shipping charges, if applicable.
  • For international orders, any customs duties, import taxes, or other charges are the sole responsibility of the Customer.

5. Cancellation, Returns & Refunds

5.1. Cancellations

  • Customers may cancel an order only before dispatch. To cancel, email us immediately at help@pathavifarms.com with your order number and reason for cancellation.
  • Once an order has been dispatched, it cannot be canceled.

5.2. Returns (Damage/Expiry Only)

  • Except for products that arrive damaged or expired, no returns or replacements are permitted.
  • If you receive a damaged or expired item, you must notify us within 3 days of delivery by emailing help@pathavifarms.com with photographic evidence and order details.
  • We reserve the right to inspect the allegedly damaged/expired product before approving any return or refund.

5.3. Return Shipping Costs. In the event of damage or expiry on delivery, Pathavi Farms will bear the return-shipping costs. No other returns or exchanges are permitted.

5.4. Refunds

  • Approved refunds will be issued to the original payment method within 7–10 working days of approval.
  • There is no restocking fee.
  • Refunds will reflect only the product price; any express-shipping charges (if applicable) will not be refunded.

6. Intellectual Property

6.1. All content on the Website—including but not limited to text, photographs, graphics, logos, button icons, audio clips, video clips, software, and data compilations—is the exclusive property of Pathavi Farms or our content suppliers, protected by Indian and international copyright, trademark, and other intellectual property laws.

6.2. "Pathavi Farms" and the Pathavi Farms logo are registered trademarks of Pathavi Farms. You may not use, reproduce, distribute, publicly display, modify, create derivative works of, or otherwise exploit any trademark, copyrighted material, without express written permission from Pathavi Farms.

7. Disclaimers & Limitation of Liability

7.1. Product Disclaimers

  • All products sold by Pathavi Farms are natural. Slight sedimentation in mustard oil is normal.
  • Do not use honey if you are allergic to honey, pollen, or bee products.
  • Pathavi Farms makes no representation or warranty that the Website or its servers are free of viruses or other harmful components; you assume sole responsibility for any software or hardware damage.

7.2. No Warranty. EXCEPT AS EXPRESSLY PROVIDED HEREIN, PATHAVI FARMS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR TITLE.

7.3. Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY LAW, PATHAVI FARMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE WEBSITE OR PURCHASE OF ANY PRODUCT, EVEN IF PATHAVI FARMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL PATHAVI FARMS' AGGREGATE LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

7.4. Force Majeure. Pathavi Farms shall not be liable for any delay or failure to perform its obligations under these Terms resulting from events beyond our reasonable control, including but not limited to Acts of God, fire, flood, earthquake, cyclone, strike, war, or governmental regulation.

8. Indemnification

You agree to indemnify, defend, and hold harmless Pathavi Farms, its officers, directors, employees, agents, affiliates, and representatives from and against any and all losses, damages, liabilities, claims, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms or any Policies; (b) your breach of any representation or warranty; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) your negligence or willful misconduct.

9. Governing Law & Dispute Resolution

9.1. These Terms and all disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of India.

9.2. Any dispute, controversy, or claim arising out of or relating to these Terms, including breach, termination, or validity thereof, shall be submitted to the exclusive jurisdiction of the courts in Delhi, India.

10. Intellectual Property Infringement

If you believe any content on the Website infringes your copyright, please provide our designated Copyright Agent the following information in writing:

  • Signature of the copyright owner or agent;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification and location of the infringing material;
  • Your contact information (address, telephone number, email address);
  • A statement by you that you have a good-faith belief that the use is unauthorized;
  • A statement that the information you provided is accurate, under penalty of perjury.

11. Modification of Terms & Policies

We may modify these Terms (and/or any of our other Policies) at any time. Updated versions will be posted on this page with a revised "Last Updated" date. Your continued use of the Website after any changes constitute acceptance of the revised Terms. If you do not agree to any modification, you must stop using the Website and/or cease your purchases.

12. Severability & Waiver

12.1. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

12.2. No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure by Pathavi Farms to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

13. Entire Agreement

These Terms, together with the Privacy Policy, Cancellation & Refund Policy, and Shipping & Exchange Policy, constitute the entire agreement between you and Pathavi Farms regarding the Website and purchase of our products, superseding any prior or contemporaneous agreements, communications, and proposals.
